PM-24-039.1 Expanding Options for Specialty and Organic Growers Final Rule Effective for the 2025 and Succeeding Crop Years

The Risk Management Agency (RMA) issued Product Management Bulletin PM-24-039 on June 27, 2024, announcing changes to several policies under the Expanding Options for Specialty and Organic Growers (EOSOG) Final Rule. The Common Crop Insurance Provisions Basic Provisions, Area Risk Protection Insurance Basic Provisions, and 7 individual Crop Provisions were released at that time. The remaining regulatory Crop Provisions included in the EOSOG Final Rule and conforming changes in non-regulatory Crop Provisions are planned for public release by their respective contract change dates (CCD).

PM-24-049 Fire Insurance Protection - Smoke Index (FIP-SI) Endorsement Effective for the 2025 and Succeeding Crop Years

Background

On May 23, 2024, the Federal Crop Insurance Corporation (FCIC) Board of Directors approved the Fire Insurance Protection - Smoke Index (FIP-SI) Endorsement. It is available beginning with the 2025 crop year as additional coverage for the Common Crop Insurance Policy, Basic Provisions and the Actual Production History Grape Crop Provisions in counties located in California. The coverage provided by this Endorsement may be combined with the Supplemental Coverage Option (SCO) Endorsement or the Catastrophic Risk Protection Endorsement (CAT).

The Federal Crop Insurance Act (Act) allows developers of approved privately-developed crop insurance products (“508(h) products”) to maintain their 508(h) products and charge a user fee to approved insurance providers (AIP) that elect to sell the policy. Section 522(b)(4)(D)(ii) of the Act and 7 C.F.R. 400.712(l)(5) provide that the Federal Crop Insurance Corporation (FCIC) Board of Directors (Board) will determine the reasonableness and approve the amount of user fee that is payable to the developer by the AIP.

Integrated Financial Analytics and Research, LLP (iFAR) the developers of the Trend Adjusted Actual Production History Endorsement (Trend-APH) advised the Federal Crop Insurance Corporation (FCIC) Board of Directors (Board) of their intent to maintain the Trend-APH endorsement and charge a user fee to approved insurance providers (AIP) selling the plan. Section 522(b)(4)(C) of the Federal Crop Insurance Act (Act) allows submitters to maintain approved 508(h) products and charge a user fee to approved insurance providers (AIP) that elect to sell the policy.
